1. Price:
The prices of the products that are offered for sale on the Website of Fattoria di Poggiopiano di Mauro Galardi, are indicated in Euros and are the current prices at the time the Buyer places the Order. Fattoria di Poggiopiano di Mauro Galardi may change the sale prices of the products at any time and without prior notice. Such change will be notified to the Buyer before the placing of any Order. Product prices include VAT, but do not include shipping charges except as indicated in the delivery costs and delivery times.
2. Products and Offers:
In accordance with Article 52 of the Italian Consumer Code (Legislative Decree No. 206 of September 6, 2005), before sending the Order, the Buyer may view on the Website of Fattoria di Poggiopiano di Mauro Galardi the information relating to the Seller, the price, including taxes and shipping costs, the essential characteristics of the product(s) or services the Buyer wishes to purchase, and may view the other mandatory information under the Italian Consumer Code. In the event of total or partial cancellation of the Order:
• the Cancellation of the Buyer’s Order will take place automatically, at no charge to the Buyer.
• The Customer Service of Fattoria di Poggiopiano di Mauro Galardi, will contact the Buyer to inform of the cancellation of the Order and offer to place a new Order excluding the unavailable product.
Fattoria di Poggiopiano di Mauro Galardi reserves the right to suspend or cancel the fulfilment of an Order and/or delivery, regardless of the nature and progress of the fulfilment, in case of non-payment or partial payment of any amount due by the Buyer, in case of problems with payment, or in case of fraud or attempted fraud related to the use of the Website of Fattoria di Poggiopiano di Mauro Galardi, even with reference to previous Orders. In the event of rejection of the Order, Fattoria di Poggiopiano di Mauro Galardi will notify the Buyer that the Order cannot be accepted within 30 business days from the date of the Order. Once the Buyer confirms the Order by clicking on “Conclude Purchase”, the Buyer declares that he/she has knowingly accepted the contents and conditions of the Order in question and, in particular, these General Conditions of Sale, prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the Buyer.
The sale shall be finalized only upon acceptance of the Order by Fattoria di Poggiopiano di Mauro Galardi, by sending an e-mail confirming that the Order has been processed, “E-mail Confirmation of Order Processing”.
Fattoria di Poggiopiano di Mauro Galardi shall be entitled to collect the full price of the Order at the moment the Buyer confirms the order clicking on “Conclude purchase”.
Fattoria di Poggiopiano di Mauro Galardi recommends that the Buyer should save the e-mails received from Fattoria di Poggiopiano di Mauro Galardi, in paper or electronic form. The Buyer is informed that the aforementioned e-mails will be sent to the e-mail address entered by the Buyer at the time of purchase. Fattoria di Poggiopiano di Mauro Galardi will not be responsible in case of invalid e-mail address entry and/or non-receipt of the Order Confirmation E-mail for reasons not directly attributable to Fattoria di Poggiopiano di Mauro Galardi. In that case the sale will be considered as final.
The offers and sales promotions reserved by Fattoria di Poggiopiano di Mauro Galardi to the Buyer are not cumulative and it is not expected that an item participates in multiple promotions in the same Purchase Order.
3. Payment:
Buyer warrants to Fattoria di Poggiopiano di Mauro Galardi to have the necessary authorizations to use the payment method chosen for the Order at the time of placing the Order.
Payment Methods:
– Credit Cards;
– Possibility to pick up the order directly in the store and then pay on delivery;
– Bank transfer.
All Orders are payable in Euros, including taxes and mandatory fees. Any bank charges will be charged exclusively to the Buyer (even in case of refund).
In case of non-payment or late (more than 2 days) payment of the Order by the Buyer, Fattoria di Poggiopiano di Mauro Galardi reserves the right to charge default interest at the legal rate of interest from the tenth business day following the date of the Order or from the notification of rejection of the bank payment. Ownership of the products ordered shall remain with Fattoria di Poggiopiano di Mauro Galardi until such time as the full consideration for the Order, including shipping charges, taxes and other mandatory contributions (where applicable) are paid in full by the Buyer. All Orders, prior to being processed, are subject to genuineness checks directly by the relevant credit card issuing institutions for the protection of the Customer. If, for any reason whatsoever, it is not possible to charge the amount due, the sale process will be automatically cancelled and the sale will be terminated pursuant to Article 1456 of the Italian Civil Code. The Customer will be informed by automatic e-mail communication.
Communications relating to the payment and the data communicated by the Customer at the time of payment happen on special protected lines and with all the guarantees ensured by the use of security protocols provided by the payment circuits.
4. Product delivery:
Products ordered by the Buyer under these GTC will be delivered to the address specified by the Buyer as the delivery address on the Order “Delivery Address”.

The shipping charges are different depending on the total amount of the Order, number of bottles to be shipped and destination:

Minimum shipping 3 bottles.
Free shipping for minimum purchase of 69€; if the total amount is less than 69€, shipping costs 10€.

Minimum shipping 3 bottles.
Free shipping for minimum purchase of 120€; if the total amount is less than 120€, shipping costs 16€.

Order preparation does not take place on Saturday, Sunday and public holidays.
These terms are provided only as a guide and absolutely non-binding for Fattoria di Poggiopiano di Mauro Galardi; these terms might change without any obligation for Fattoria di Poggiopiano di Mauro Galardi, depending on circumstances as period and/or other issues and/or circumstances and issues of the Carrier. Fattoria di Poggiopiano di Mauro Galardi is not responsible of delays for reasons not attributable to Fattoria di Poggiopiano di Mauro Galardi.
It is possible to request in the notes of the Order a specific delivery time. Fattoria di Poggiopiano di Mauro Galardi might charge extra costs that will cause the cancellation of the Order in case of nonfulfilment of the full payment.
6. Defects, product nonconformities and damages:
The Buyer, or the recipient of the Order, is requested to check the condition of the package and products at the time of delivery.
The acceptance of the delivery from the Buyer, or the recipient of the Order, excludes any responsibility of the Carrier and of Fattoria di Poggiopiano di Mauro Galardi for any anomaly in the package (damaged or opened package, trace of liquid, etc.)
Any anomaly in the ordered products (missing, defective or damaged products) must be reported to Fattoria di Poggiopiano di Mauro Galardi on the same day of acceptance of the delivery. The missing report of anomalies on the same day of acceptance of delivery excludes any responsibility of Fattoria di Poggiopiano di Mauro Galardi for anomalies in the ordered products (missing, defective or damaged products).
If the Carrier does not deliver because of:
• missing or incorrect information for the delivery
• maximum number of attempt of delivery by the Carrier
the product(s) will be returned to Fattoria di Poggiopiano di Mauro Galardi.
Fattoria di Poggiopiano di Mauro Galardi cannot be considered responsible of any delay in the delivery and/or failed delivery and/or anomalies in the package (damaged or opened package, trace of liquid, etc.) once the Carrier takes charge of the shipping. At the moment of the Order, it is possible to request an insurance for the goods, prior payment for the corresponding extra cost. In case of anomalies of the package (damaged or opened package, trace of liquid, etc.) with insurance of the goods, Fattoria di Poggiopiano di Mauro Galardi will refund the Buyer with the amount liquidated by the Carrier and when the amount will be effectively cashed in by Fattoria di Poggiopiano di Mauro Galardi.
In case of anomalies in the package (damaged or opened package, trace of liquid, etc.) and/or in the ordered products (missing, defective or damaged products), the Buyer or the recipient of the Order shall return the products to Fattoria di Poggiopiano di Mauro Galardi following the procedures described below. Failure to follow the correct procedure precludes any recourse against the Carrier and/or Fattoria di Poggiopiano di Mauro Galardi, including the right to a refund of the Order and/or the redelivery of the products ordered. The Buyer, or the recipient of the Order, may alternatively contact Fattoria di Poggiopiano di Mauro Galardi Customer Service to learn how to return the damaged, non-conforming and/or defective product(s). The procedure for the return of damaged, non-conforming and/or defective product(s) that will be indicated by Fattoria di Poggiopiano di Mauro Galardi Customer Service must be followed by the Buyer. Otherwise, the Buyer may not claim any refund or replacement of the affected products.
Following, the procedure that must necessarily be followed in the case of visible damage and/or anomaly of the package, noted in the presence of an express courier shipping manager:
• Reject the delivery and write on the courier document the set of reservations regarding the anomaly in a clear and detailed manner;
• Forward a report regarding the refused pickup to Fattoria di Poggiopiano di Mauro Galardi by e-mail at info@poggiopiano.it
Following, the procedure that must be followed in case of a missing, damaged or defective product:
• Forward a report regarding the missing, damaged or defective product to Fattoria di Poggiopiano di Mauro Galardi by e-mail at info@poggiopiano.it
• The Customer Service of Fattoria di Poggiopiano di Mauro Galardi may ask for information regarding the identity of the Buyer, or the recipient of the Order, and undertake any verification that may be useful.
• The Customer Service of Fattoria di Poggiopiano di Mauro Galardi will indicate to the Buyer, or to the addressee, the procedure to be followed to return the damaged or defective product, or to receive the missing products.
• Upon receipt of the products, Fattoria di Poggiopiano di Mauro Galardi will verify that such products are indeed defective, damaged or do not match the description provided on the Website.
• If such verification is positive, Fattoria di Poggiopiano di Mauro Galardi will replace the defective, damaged or non-conforming product and send it to the Buyer as soon as possible and in any case within 30 (thirty) working days from reception of the products. Shipping costs will be borne entirely by Fattoria di Poggiopiano di Mauro Galardi. In the event that Fattoria di Poggiopiano di Mauro Galardi is not able to proceed with the replacement of the products within the aforementioned period, Fattoria di Poggiopiano di Mauro Galardi will immediately notify the Buyer at the email address provided at the time of registration of the purchase and will reimburse the Buyer for the cost of such products and shipping costs where the Buyer provides proof of the cost incurred to return the products. The reimbursement will be made by Fattoria di Poggiopiano di Mauro Galardi in the manner chosen at its discretion as soon as possible, and in any event within 30 (thirty) business days from the date on which it receives the products.
• In the event that, after examining the returned products, Fattoria di Poggiopiano di Mauro Galardi finds reasonably that the products cannot be considered defective, damaged or do not conform to the description on the Website, the Buyer will not be entitled to a refund and the products will be returned to it, with shipping costs charged to the Buyer.
7. Right and terms for withdrawal exercise:
According to the provisions of the law (art.59 paragraph E DLGS 21/2/2014), the Buyer may, within the term of 14 (fourteen) working days from the date of reception of the package containing the ordered goods, withdraw from the purchase contract without penalty and without any reason by contacting customer service. The Buyer, by exercising the right of withdrawal under this article, within the terms and in the manner described below for the return of the products, may obtain at its option:
• a refund of the amount paid for the products returned to the central warehouse, by re-crediting the relevant amount to its credit card or by bank transfer;
• the possibility of exchanging, at the point of sale of Fattoria di Poggiopiano di Mauro Galardi, the products purchased on the Website www.poggiopiano.it with other products available in the store;
• the credit of an amount equal to the price of the products returned to the central warehouse, usable only on the Website of Fattoria di Poggiopiano di Mauro Galardi
Pursuant to Article 67 paragraph 3 of the Italian Consumer Code, the costs of return will be borne exclusively by the Buyer.
Fattoria di Poggiopiano di Mauro Galardi will refund the customer the full amount already paid for the product within 14 (fourteen) days of reception of the Return Form containing the decision to exercise the right of withdrawal. Fattoria di Poggiopiano di Mauro Galardi may withhold the refund until it has received the goods.
The refund will be made through the procedure of reversal of the amount charged to the Credit Card or by Bank Transfer using the bank details (IBAN Code of the invoice holder) provided of the Buyer on the Return Form.
The products must be returned to Fattoria di Poggiopiano di Mauro Galardi in their substantial integrity, with their original packaging, accessories and anything else supplied with them, in a condition such that they can be put back on sale.
Parcels sent at the expense of the recipient will not be accepted.
The Buyer and/or the recipient of the Order must necessarily fill out the appropriate Return Form, received by email after contacting the Customer Service, duly completed and signed as indicated.
To exchange products purchased online in the store of Fattoria di Poggiopiano di Mauro Galardi, the Buyer must present a copy of the purchase invoice or order processing confirmation received with the goods.
The exchange can be made only with products of equal or greater amount than those returned. Even partial re-credit of the amount spent can in fact be obtained only by returning the product to the headquarters. The return of products beyond the legal deadline established for withdrawal and contractual cancellation will not be accepted.
Withdrawal exercise is not possible in case of products that are personalised or tailor-made, on goods subject to rapid deterioration or close expiry date, on sealed goods that are opened and are not returnable for hygienic purposes.
Withdrawal exercise is applicable only for Buyers from European Union.
8. Liability:
The Buyer declares to have full capacity to act and enter into a contract for the purchase of products and/or services on the Website on the basis of these General Terms and Conditions of Sale.
Fattoria di Poggiopiano di Mauro Galardi shall under no circumstances be required to verify the capacity to act of visitors and Buyers of the Website of Fattoria di Poggiopiano di Mauro Galardi. In the event that a person lacking the necessary capacity to act (e.g. a minor) places an Order on the Website of Fattoria di Poggiopiano di Mauro Galardi, without prejudice to the responsibility of his or her parents or legal guardians for such Order and the related payment, Fattoria di Poggiopiano di Mauro Galardi may refuse to accept the Order.
